CFTC Moves to Dismiss CME Lawsuit Over Crypto Perpetual Futures

The US Commodity Futures Trading Commission (CFTC) has filed a motion to dismiss a civil lawsuit brought by the Chicago Mercantile Exchange (CME) Group over the regulator's classification of cryptocurrency perpetual futures. In a Wednesday filing in the US District Court for the District of Columbia, lawyers representing CFTC Chair Michael Selig and the commission argued that CME lacked standing to challenge the agency's actions, calling the case "much ado about nothing" and requesting an oral hearing.

CME originally filed suit in June after the CFTC approved perpetual futures contracts tied to Bitcoin's spot price for prediction markets platform Kalshi and issued a no-action position for similar products on Coinbase. The exchange's complaint alleged that Selig acted unilaterally without a full panel of five commissioners and violated the Commodity Exchange Act by treating futures contracts as swaps with expiration dates. The CFTC countered that CME could not demonstrate concrete financial injury, noting that "any CFTC-registered exchange can list perpetual futures on digital assets" and that CME "does not argue that it could not list this same type of futures contract."

A CFTC spokesperson previously characterized CME's legal challenge as "lawfare" and dismissed the June complaint as "frivolous." As of Thursday, the oral hearing requested by Selig and the commission had not yet been scheduled on the public docket. The case carries significant implications for how US regulators oversee emerging crypto derivatives products and the competitive landscape between traditional exchanges and newer digital asset platforms.

Separately, the CFTC is seeking public input on AI compute futures contracts, while CME is reportedly eyeing an October launch for its own offerings in that space—a parallel development underscoring the agency's evolving approach to novel financial instruments tied to both digital assets and emerging technologies.
