CLARITY Act Defeat May Fuel $30M Crypto PAC Spending in 2026 Midterms

The US Senate's failure to advance the Digital Asset Market Clarity (CLARITY) Act on Sept. 15, where the bill fell short 49-50, has set the stage for the cryptocurrency industry to escalate political spending ahead of the 2026 midterm elections just 42 days away. Fairshake, a super PAC backed by Coinbase and Ripple Labs, has already announced plans to pour $30 million into opposing Sherrod Brown in Ohio's Senate race. Brown, who previously chaired the Senate Banking Committee, has historically championed policies opposed to the crypto industry, and economists warn his potential return to the chamber could block future digital asset legislation.

The political stakes extend beyond Ohio. Fairshake spent approximately $130 million on ads during the 2024 election cycle, including roughly $41 million specifically to oppose Brown in his losing bid against Republican Bernie Moreno. Legal analysts suggest the CLARITY vote has given the industry a clear benchmark for identifying reliable congressional allies. "It will be difficult for those who voted against Clarity to make the case that the industry should support them financially in the midterms," noted Steve Gannon, a partner at Davis Wright Tremaine, in comments to Cointelegraph.

While some crypto advocates have not ruled out a revised CLARITY bill returning for a lame-duck session vote, the industry's political infrastructure is already mobilizing. Stand With Crypto, a Coinbase initiative launched in 2023, has issued warnings to lawmakers who failed to advance the bill. Economist Paul Krugman argued in a Tuesday Substack post that Brown's potential return could give Democrats a decisive vote on crypto policy, adding that "the Democratic Party is not immune to financial influence from crypto." With control of both chambers of Congress in play, the CLARITY Act's defeat appears poised to reshape the financial landscape of the 2026 midterms significantly.
