ESMA Orders EU Crypto Firms to Exit Non-Compliant Stablecoins by Jan 2027

The European Securities and Markets Authority (ESMA) has directed EU crypto firms to halt all services involving stablecoins that do not comply with the Markets in Crypto-Assets Regulation (MiCA) framework, setting a hard deadline of January 8, 2027, for firms to address existing client exposures. National regulators are expected to require crypto-asset service providers (CASPs) authorized under MiCA to stop offering trading, exchange, custody, transfer, advisory, and portfolio management services tied to unauthorized stablecoins. ESMA stated that companies should address remaining exposures "as soon as possible," giving them roughly three months from the October 8, 2026 announcement to wind down affected operations.

The guidance requires crypto firms to implement technical, contractual, and organizational controls to prevent EU clients from acquiring or increasing holdings of non-MiCA-compliant stablecoins. However, ESMA acknowledged that regulators may permit limited temporary services to help clients exit existing positions, including liquidation, conversion, withdrawal, transfers, and safekeeping, provided these activities are closely supervised. This phased approach aims to balance enforcement of the MiCA framework with the practical need to protect clients who currently hold unauthorized stablecoins.

This update expands on ESMA's January 2025 guidance, which first called for restrictions on trading and exchange services involving non-compliant stablecoins. The latest escalation signals that EU regulators are tightening oversight of the stablecoin market ahead of the MiCA stablecoin regime becoming fully operational. The move comes alongside parallel regulatory developments across Europe, including the European Banking Authority's recent call for dedicated crypto lending rules under MiCA and Russia's clearance of its first licensed crypto exchanges and custodians under new national legislation.
